The Pemtittee, Western Mobile Southern, Inc. desires to cwtduct a muting operation lmown as <br />Beeman Pit #1, for the purpose of eanracting sand and gravel and borrow material for construction. The <br />Pemuttce will not mine any secondary commodities at this site. <br />B. On Apri124, 2002 the Mined land Reclamati~ Board (the "Board") approved the Pemuttee's <br />application for this permit, fixed the amorurt of the fntaztcial warranty and directed that this pemrit be issued upon <br />the filing with the Division of Minerals and Geology (the "ITivision'~ of perfomiartce warranty and financial <br />warranty (or warrarnies) in the amoum so fixed in form and substance approved by the Division. Said warranties <br />have been filed with the Division. <br />C. If the Pem»ttee desires to extract materials other than those listed in (A), a separate pemut may <br />be retritired. <br />D. On Apri] 24, 2002 the Board made the following findings: <br />1. The application for this pemrit complies with the requirements of the Colorado Mined <br />Land Reclamation Act fur the Extraction of Construction Materials, C.R.S. 34-32.5-101 et seq., as amarded, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />permanent man-made structure located within two hundred feet of the Affected band, except where there is an <br />agrcemari betwcen the Operator and the persons having an interest in the stmcture that damage tp the structure is <br />to be corrrpensated for by the Pennittee; and; <br />
