<br /> <br />~; <br />.~ <br />.~ <br />'=-TUTTLE APPLEGATE RINDAHL, INC. <br />:S Consultants for Land and Resource Development <br />Mr. Michael Boyd <br />Mined Lantl Reclamation Division <br />August 16, 1989 <br />Page 3 <br />Rocky Mountain Consultants states in Exhibit H that there are "no <br />threzttened or endangered species known to exist in this area." <br />Since: the reclamation plan offers such expanded opportunities for <br />wildlife over the present situation, the former firm may have <br />believed that further investigation of wildlife was unnecessary. <br />In etddition this operation was approved by Lorimer County who <br />normally sends a referral to the Division of Wildlife, the County <br />Parkr; and Open Space Department, and the Colorado Forest Service. <br />All of these agencies should have input into the approval process <br />at t:he County level and their comments should have been <br />incorporated into the approved mining permit. <br />Reclamation Cost (Exhibit L) <br />1. We understand your scenario regarding the reclamation where a <br />water. surface is not involved. Our reclamation sheets in Exhibit <br />L are attached with this letter and reflect this scenario. <br />For your information in reviewing the revised Exhibit L, the <br />boring logs show that an average of one foot of topsoil and an <br />average of four feet of overburden exist on top of the sand and <br />gravel deposit. These depths have been used in the redistribution <br />of the overburden and topsoil. <br />With regard to the buildings and equipment, one would assume that <br />any defaulted operator would remove any buildings and equipment of <br />value. If not, the Division could take title to the equipment and <br />buildings and sell them at auction. The auction proceeds should <br />mare than cover the reclamation costs.
