Based on the authority confered to the C.S. Fish and Wildlife Service (Service] by the
Endangered SDecies .pct of 1973 (ESA), as amended (16 li.S.C. 1631 er seq.), the Service
reviewed the lireble's meadowjumping mouse, Zapus hudsonius prebiei (Preble's), habita:
assessment report submitted with vour Letter of Tanuary 23, 2003. This report regards the
aroposed site plan revtew for the Duckworth Pit on Idaho Creek in Weld County, Colorado.
i nts project. as proposed. may disturb riparian habitats.
Based on the information provided, and given vour compliance with the Preble's survey
guidelines, the Service finds the report acceptable and a~ees that a population of Preble's is not
iike'.y to be present within the subject area. Thus, the Service concludes that the proposee project
on tnis site should not have direct adverse affects to Preble's. Should Preble's populations exist
downstream from the site, actions on the site that result in significant modifications of Preble's
habitat downstream (for example, through alteration of existing flow regimes, o: sedimentation)
may be subject to provisions of the ESA.
