ditch to facilitate mining according to the enclosed "Final Engineering Plans, Smith and <br />Emmons Ditch Relocation" as indicated in the signed, notarized agreement. The relocated <br />portion of the Smith & Emmons ditch will be concrete lined and constructed on unmined <br />ground at the western property boundary. <br />Mining will occur in Phase II after installation of the concrete lined ditch. The minimum, <br />agreed upon offset is 60-feet from the western property line; mining will occur at a 3:1 <br />slope. The concrete lining will protect from impacts due to dewatering, however Lafarge <br />will pump dischazge water into the Smith & Emmons ditch for conveyance to the <br />Lighthouse Cove pond as stated in the Agreement. <br />Construction of the proposed concrete lined ditch maybe accomplished during the <br />irrigation season (March through November), as long as the work does not negatively <br />affect the maintenance and/or operations of the existing Smith & Emmons ditch. Any work <br />retated to the existing ditch, including connections to the existing ditch, modifications to <br />the existing diversion structures and filling of the existing ditch, will occur during the non- <br />irrigation season (November through March). Lafazge will take all precautions to ensure <br />that water delivery during the irrigation season will not be affected by this work. <br />OMG ! 11 Permit <br />Page /U oj49 <br />
