• The material excavated will be tested to determine its suitability as a topsoil-like medium and <br />utilized in reclamation. The material that is not suitable for atopsoil-like medium will be graded <br />into the surrounding topography within the disturbance area, topsoiled, and revegetated in <br />accordance with Peabody's approved reclamation plan. Site specific conditions will determine the <br />construction methods and equipment utilized at the time of excavation. Sediment removal and <br />water discharges will be conducted consistent with the approved mining permit, the NPDES <br />permit, and Section 4.05.6(3)(b). All sedimentation ponds will be inspected annually under the <br />supervision of a registered professional engineer and reported to the OMLRD. <br />All sedimentation ponds and impoundments will be maintained until the vegetation success <br />requirements of Tab 22 are met, and the drainage leaving the pond meets applicable State and <br />Federal water quality requirements, if any, for the receiving streams. Attachment 13-M contains <br />the determinations for reclaiming temporary Pond 003. <br />All sedimentation pond slopes will be protected from erosion where surface runoff enters the <br />ponding area. <br />Monitoring for rills and gullies on pond slopes will be carried out on a periodic basis; the <br />monitoring being geared to those periods after spring snowmelt and during required quarterly <br />• pond inspections. <br />Occurrence of excessive rills and gullies will result in implementation of the following plan. One <br />of, or a combination of, the following options and corrective methods will be employed: <br />If it is determined that the topography of the regraded area is such that drainage is <br />concentrated in a particular area, then this area will be improved to accept the runoff. In <br />areas where no natural armoring is present, the drainage bottom or channel will be <br />reshaped, if needed. The channel bottom will either be seeded, covered with erosion <br />matting and seeded, or rocked. The method used will, of course, depend on site conditions. <br />Continued observations will be made of this area for problems or necessary maintenance. <br />On slopes where no swale or defined channel exists, regrading, or disking, or chisel plowing <br />will be performed, depending on the extent of the erosion. Reseeding will then take place. <br />In addition to the above, contour furrows in and above the erosion area may be constructed <br />to trap and slow down the runoff. Straw dikes can also be used where appropriate to <br />control runoff and promote revegetation. <br /> <br />13-5 <br />
