A copy of a notice stating that <br />written comments must be received by the Mined Land <br />Reclamation Board by 5:00 o'clock on July 12, 1988 was <br />enclosed in the letter. <br />Lazy D Grazing Association protests the application to <br />mine sand and gravel in Section 26 or in the near vicinity <br />and as grounds for the protest would state: <br />The Lazy Grazing Association owns the East-1/2 of <br />Section 26, Township 11 North, Rage 67 West of the 6th P.M. <br />which is contiguous to the Land which is the subject of the <br />hearing. (The West half of Section 26-11-67). The <br />association owns or leases all of Section 25 and 36, Township <br />11N, Range 67 West Section 31, Township 11N, Range 66 West, <br />and Section 6, Township lON, Range 66 West of the 6th P.M. <br />The land is used to pasture cattle. Lazy D Grazing <br />Association depends upon the water in Lone Tree Creek to <br />provide water for the cattle. A rough drawing showing the <br />approximate location of Lone Tree Creek in relation to the <br />lands herein described is enclosed. <br />Lone Tree Creek traverses Sections 26 and 36, Township <br />11 North, Rage 67 West, Section 1, Township 10 North, Range <br />67 and Section 6, Township 10 North, Range 66 West. The <br />creek carries water the entire year except of course in very <br />dry years. The water from Lone Tree Creek is the only source <br />of water for cattle upon the Lazy D range in the area. There <br />are other ranchers to the south and east who also heavily <br />rely upon Lone Tree Creek as a source of water for their <br />cattle. <br />
