EXHIBIT D <br />MINING PLAN <br />The information for this section is intended to satisfy the requirements outlined in Section <br />6.4.4 of the Colorado Mined Land Reclamation Board's Construction Material Rules and <br />Regulations. <br />A. Background <br />The purpose of this application is to obtain authorization for Hall-Irwin Corporation <br />(Hall-Irwin) to mine, process and sell sand and gravel and to operate concrete, recycling <br />and asphalt batch plants at the Water Resources, LLC property. Hall-Irwin will mine <br />approximately 87 acres of a +125.88-acre parcel located near Greeley, Colorado. Please <br />see the attached Mining Plan Map for the specific location of the area to be mined. <br />B. Operational Methods <br />a. Description of mining method: <br />The applicant will begin mining at the east side of the property and proceed <br />west through the site in phases to minimize the amount of land disturbed at any <br />one time. The site will basically be mined beginning on the northern most half <br />of the site mining phases I and 2 from west to east. Phases 3-6 are in the <br />southern and western portions of the site and will be mined east to west, starting <br />at the point furthest from the processing area and working toward it. Please <br />refer to the Mining Plan Map for details on the phasing order. <br />Site preparation <br />Initial disturbance of the property will include: <br />• The slurry wall will be constructed around the perimeter of the mining area. <br />• The perimeter berms will be installed along Weld County Road (WCR) 58. <br />The applicant will plant grass along the berm to help screen the site. The berms <br />are designed to allow historic drainage and flood waters to pass through the site <br />unobstructed. <br />• The area adjacent to the intersection will include signage for the facility. Once <br />mining is complete, the signage will be removed and the entrance will serve as <br />access to the water storage reservoirs. <br />• The overburden material from Phase 1 will be used to fill the processing area <br />above the 100-year floodplain to allow historic flood drainage to pass through <br />the site and around the processing equipment without impacting the processing <br />equipment. <br />Proposed Mining Process for Each Section <br />Before any mining commences, the operator will install a dewatering trench <br />around the mining area. This water will be pumped into the existing irrigation <br />ditch located along the northern edge of the property.
