Rule 6.4.19 As discussed above, the Boyd Lake Outlet Ditch is owned by the applicant. <br />The stability of the ditch is discussed in the attached Slope Stability Analysis. The above <br />ground utility line to the northwest of the permit area is 200 feet from the permit <br />boundary and 230 feet from the limit of mining. The utility line does not meet the criteria <br />for inclusion in this exhibit. The 3-strand barbed wire fences surrounding Phase I, as <br />shown on the map, are owned by the Flying W Ranch, lessor of the Phase I property. <br />These fences aze also discussed in the attached Slope Stability Analysis. <br />The following information is in response [o the comments from the Division of Wildlife. <br />Large trees in the azeas labeled `Undisturbed Area' will not be removed. These aze the <br />locations of the majority of the trees. The property owner of Phase I has not requested <br />that replacement or additional trees be planted on their property. Phase I is to be returned <br />to pastureland. There are no trees in Phases II or III.. These areas are to be returned to <br />pastureland/grass hay meadow and a developed water resource. We are no[ proposing to <br />return any of the areas to wildlife habitat. If wildlife choose [o return to the area <br />following the mining and reclamation of the property, that is acceptable to the property <br />owners, but they do not wish to plant and develop wildlife habitat. <br />The applicant is satisfied with the grass seed mixes already proposed for the azeas. <br />The lake in Phase III is proposed as a sealed reservoir for potential water storage. Jetty- <br />type structures, islands, flatter slopes than proposed and an irregulaz shoreline all decrease <br />the potential storage volume of this site. Again, as this site is not proposed as wildlife <br />habitat the applicant chooses not to make these suggested revisions [o the plan. <br />We believe the above and attached information addresses the concerns and comments of the <br />Division.
