TERNS AND CONpITIONS <br />PART I <br />Page ld of 19 <br />Permit No. CO-0000221 <br />g) Additional conditions - effective at all times for all discharge points: <br />There shall be no discharge of floating solids or visible foam in other than <br />trace amounts. The discharge shall not contain any sanitary wastewaters from <br />toilets or related facilities, or other pollutants not associated with active <br />mining operations. There shall be no land application of wastewater, other <br />than for dust control, without the previous authorization of a specific <br />discharge point. <br />2. Burden of Proof Requirements - 009, 010 ' <br />The permittee shall have the burden of proof when requesting relief from total <br />suspended solids (TSS), total iron and/or settleable solids limitations. <br />For rainfall, to waive TSS and total iron Limitations, it is necessary to prove <br />that discharge occurred within 48 hours after measurable precipitation has <br />stopped. In addition, to~waive settleable solids limitations, it is necessary to <br />prove that discharge occurred within 48 hours after precipitation greater than the <br />10-year, 24-hour storm event. <br />For snowmelt, to waive TSS and total iron limitations, it is necessary to prove <br />that discharge occurred within 48 hours after pond inflow hoe stopped. In <br />addition, to waive settleable solids limitations, it is necessary to prove that <br />discharge occurred within 48 hours after pond inflow volume greater than the <br />10-year, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. See Section I.8.3. <br />3. Post-Hinina Areas - all discharge points <br />Commencing at the time active mining has ceased and surface areas have been <br />returned to the required contour, all applicable discharges shall be subject to <br />limitations other than those specified in Part I.A.L. These post-mining <br />limitations shall remain in effect until bond release. The permittee shall notify <br />the Division upon cessation of active mining so that appropriate permit <br />modifications can be made. <br />L J <br />
