The Division has reviewed the materials you supplied in response to the Division's initial adequacy review of the
application for the Diamond Rock Pit and has identified the remaining adequacy issues:
NOTICES: You have supplied evidence of the intended publication of the newspaper notice of your application in
the Huerfano World on 12/14/00 but not evidence of the actual publication.
Please provide evidence from the newspaper that the notice was actually published.
WARRANTIES: Neither a financial nor a performance warranty for the operation has been supplied a[ this time.
However, although you do not need to supply either a performance or financial warranty in order that your
application be approved, both warranties will eventually have to be supplied in a form acceptable to the Division in
order that a permit be issued for the operation.
EXHIBIT C (Rule 6.3.3(b)): You properly indicated that topsoil will be salvaged and stockpiled in the southern end
of the permit area. However, since reclamation of the pit will not take place until mining has ceased, it is also
necessary that you specify how the stockpiled topsoil will stabilized with vegetation or by other means in order co
protect it From deterioration, erosion or contamination.
Please comply Fully with [he requirements of this Rule and specify how you will stabilize [he stockpiled
topsoil until it is needed for reclamation.
EXHIBIT C (Rule 6.3.3(h)): You have indicated the possible need for some water in conjunction with your
operation but, given that need may be limited, you have not properly identified the source of that water as this Rule
requires.
Please comply fully with the requirements of this rule and specify the source of the water you may require
for your operation.
EXHIBIT D (Rules b.3.4(1)(f), (2), (3), and (4)): There is very little difference between the estimate of the cost of
reclaiming [he site supplied in your response and the Division's cos[ estimate.
If you are agreeable, the Division will accept your posting a financial warranty in the amount of $16.000.00
for the Diamond Rock Pit.
NOTE: The current dectsion date for [his application is now January 02, 2001. Please respond fully [o the remaining
adequacy issues identified above well enough in advance of that date that [he Division may review the response,
deal with any remaining issues and consider approval of the application at that time. if you cannot respond fully by
January 02. 2001, please provide a written waiver of your right to a decision at that time in order [o avoid a dental of
the application and to allow the permil[ing process to continue.
