LOng <br />Division Director <br />The Division has reviewed the materials you supplied in response to the Division's initial adequacy review of the <br />application for the Diamond Rock Pit and has identified the remaining adequacy issues: <br />NOTICES: You have supplied evidence of the intended publication of the newspaper notice of your application in <br />the Huerfano World on 12/14/00 but not evidence of the actual publication. <br />Please provide evidence from the newspaper that the notice was actually published. <br />WARRANTIES: Neither a financial nor a performance warranty for the operation has been supplied a[ this time. <br />However, although you do not need to supply either a performance or financial warranty in order that your <br />application be approved, both warranties will eventually have to be supplied in a form acceptable to the Division in <br />order that a permit be issued for the operation. <br />EXHIBIT C (Rule 6.3.3(b)): You properly indicated that topsoil will be salvaged and stockpiled in the southern end <br />of the permit area. However, since reclamation of the pit will not take place until mining has ceased, it is also <br />necessary that you specify how the stockpiled topsoil will stabilized with vegetation or by other means in order co <br />protect it From deterioration, erosion or contamination. <br />Please comply Fully with [he requirements of this Rule and specify how you will stabilize [he stockpiled <br />topsoil until it is needed for reclamation. <br />EXHIBIT C (Rule 6.3.3(h)): You have indicated the possible need for some water in conjunction with your <br />operation but, given that need may be limited, you have not properly identified the source of that water as this Rule <br />requires. <br />Please comply fully with the requirements of this rule and specify the source of the water you may require <br />for your operation. <br />EXHIBIT D (Rules b.3.4(1)(f), (2), (3), and (4)): There is very little difference between the estimate of the cost of <br />reclaiming [he site supplied in your response and the Division's cos[ estimate. <br />If you are agreeable, the Division will accept your posting a financial warranty in the amount of $16.000.00 <br />for the Diamond Rock Pit. <br />NOTE: The current dectsion date for [his application is now January 02, 2001.
