The Funding Parties agree that escrowed funds used and drawn upon by the Black <br />Hawk.- Central City Sanitation District as provided for in pazagraph 2.3:L of the Earlier Stipulation <br />shall be withdrawn pro rata to the parties' respective original contribution of funds. <br />6. The Church Ditch Company does not intendto provide funds or to become aFunding <br />Party, but agrees to become a signatory to the Eazlier Stipulation; thus becoming a stipulatorthereto. <br />7. The Parties ag~ee that none of the funds shall be withdrawn from escrow by the Black <br />Hawk -Central City Sanitation District until the entire $1,500,000 (2000 dollars) has been funded <br />in accordance with pazagraph 2,3.2 of the Earlier Stipulation, and the separate escrow agreement <br />under the Eazl;er Stipulation shall so provide, If the entire funding of the $1,500,00 (2000 dollars) <br />under paragraph 23:2 of the Earlier Stipulation does not occur by December 31, 2000, then all <br />monies placed in escrow shall be returned fo the respective Funding Parties. <br />8. The City of Northglenn enters into this stipulation on the basis of, and with the. <br />understanding that, the initials "TW I" as used in the Earlier Stipulation aze intended tb include all <br />oftheprocessesassetforthinpatagraph2.2oftheEazlierStipulation. Should additional wastewater <br />treatment at the New Plant beyond that described at paragrapfi 2.2 of the Earlier Stipulation be <br />required by the U.S. Environmental Protection Agency, the Colorado Department of Public Health <br />and Environment, or any other entity with authority to do so, neither the'City ofNorthglenn nor any <br />of the Funding Parties shall be obligated to fund the costs ofproviding for such additional treatrnent. <br />Should the amount necessary to meet the objectives of the TWT as defined in paragraph 2.2 of the <br />Earlier Stipulation exceed $1,500,000 (2000 dollas), the City ofNorthglenn agrees to discuss such. <br />funding with the other Funding Parties but does not obligate itself to use its "best' efforts" to the <br />allocation and funding of such amounts. <br />9. The Parties further agree that this stipulation does not supezcede. the Eazlier <br />Stipulation, or supercede the prior stipulation dated February 23, 2000 entered' into by and among <br />the City of Black Hawk, the City of Central, the Boazd of County Commissioners of the County of <br />Gilpin; and the City of Thornton. <br />10: The City of Northglenn agrees that as a Funding Party the City of Northglenn will <br />comply with the requirements ofResolution No. 2000-1. of the Black Hawk -Central City Sanitation <br />District dated January 24, 2000, a copy of which is attached hereto as Exhibit B. <br />11. This stipulation shall not be.binding unless and until all of the Parties have dL~1y <br />executed this stipulation through eachparty's respective counsel. The Parties; other,than the City <br />of Northglenn and the Church Ditch Company, have all previously executed the Earlier Stipulation <br />through each party's respective counsel. <br />
