Stipulation <br />Cases Nos. 92-CW-OS9, 92-CW-168, 94-CW-036 <br />Page 3 <br />Other. <br />5.1 Bytheirrespectivecounsel'ssignaturesbelow,theFundingPartiesstatethattheywillbudget <br />and appropriate or otherwise make available sufficient funds in fiscal year 2000 to fund theiz <br />respective obligations under pazagraph 2.3.1, above, tivith the exception of the Coors Brewing <br />Company. In the case of Coors Brewing Company, by the sigiiature of counsel below they state that <br />they will budget and otherwise make available sufficient funds in fiscal year 2000 or before January <br />31, 2001. <br />5.2 A motion shall be filed by the stipulators requesting the Court to approve this stipulation, <br />with each party to beaz its own costs and attorneys fees, together with a resolution of the District's <br />Boazd of Duector; approving and agreeing to comply with the terms of this stipulation. <br />5.3 This stipulation shall address only the instant cases 92CW059, 92CW168, and 94CW036, <br />Subsequent Water Court Cases, and Case No, 94CW277 and shall not apply to or affect any other <br />proceedings. Accordingly, except as limited by the provisions of the "Cosmic Agreement" among <br />Coors, Golden, Westminster and Thornton dated May 23, 1988, the stipulators shall be and remain <br />free to advance water quality concerns, and pursue water quality relief, in other water court cases and <br />in other forums, including without limitation the Colorado Water Quality Confrol Commission and <br />the Colorado Legislature, provided that so long. as this stipulation is in effect, all parties hereto agree <br />not to seek to impose additional conditions or limits on the District's CDPS permit(s) other than by <br />rule or statute. <br /> <br />
