Banks and Gesso, LLC <br />EXHIBIT M -OTHER PERMITS AND LICENSES <br />Additional permits/approvals required for the Heit property are listed below <br />Weld County Use by Special Review Permit <br />An application for a Use By Special Review Permit is being submitted concurrently with <br />this CDMG 112 Permit application to Weld County, Colorado as part of the land use <br />permission granted to mine the Heit property. <br />CDPS State Discharge Permit/Stormwater Permit <br />Prior to any ground-disturbing activities at the proposed permit area, a <br />CDPS/Stormwater Permit will be obtained from the Colorado Department of Public <br />Health and Environment (CDPHE) that will account for any and all off-site discharge and <br />will contain a plan for control of that discharge. <br />Air Permits <br />Prior to any ground-surface disturbing activities (topsoil removal and stockpiling, access <br />road development, haul road construction or material hauling) for the subject property, <br />the Applicant will obtain an Air Pollution Emissions Notice (APEN) from the CDPHE. <br />This permit will be kept active during the entire life of the mine. <br />Road Access and Maintenance~reement <br />The mining operation will utilize access directly onto Weld County Road 25 (WCR 25) <br />during the life of the mine. Haul trucks will head south on WCR 25 to WCR 18. Then, <br />the trucks will head east on WCR 18 to Hwy 85. For each of these county roads, Access <br />Permits from Weld County will be required. <br />Temporary Substitute Supply Plan (TSSP)/Gravel Pit Well Permit <br />A TSSP and Gravel Pit Well Permit will be submitted to the State Engineer for review <br />and approval prior to commencement of any mining below groundwater levels on the <br />property. <br />Heit Sand and Gravel Mine 02044 <br />SW Meadow, LLC February 2003 <br />22 <br />
