Banks and Gesso, LLC <br />INTRODUCTION <br />This document presents an application for a State of Colorado, Division of Minerals and <br />Geology, Colorado Mined Land Reclamation Board (CMLRB) Construction Materials <br />Regular 112 Operation Reclamation Permit <br />The Applicant, SW Meadow, LLC, is applying for this permit to mine sand and gravel <br />from the Heit property, which is located in unincorporated Weld County, Colorado. The <br />property consists of approximately 102 acres, generally described as lying in the South <br />'/z of the NE '/< of Section 13 and part lying in the North '/z of the SE Y< of Section 13, T <br />2N, R 67W of the 6`h P.M., and can be identified by Weld County Parcel <br />#131113001002. Please refer to Exhibit A for a complete legal description. The <br />operation will run under the name of the Heit Sand and Gravel Mine. <br />The property is currently agricultural land. There are two gas wells located on the site, <br />and three flow-lines run through the property. Heit Farm, LTD currently owns the <br />surface and subsurface rights on the property, which includes the oil, gas and mineral <br />interests. However, the Applicant has a contract to purchase the property for the <br />purposes of sand and gravel mining, which is contingent on approval of the necessary <br />land entitlement permits. <br />The property will be mined for sand and gravel, with processing into saleable product <br />occurring on the site. There will be one concrete batch plant and one asphalt batch <br />plant on site. Some material will be used in the production of concrete and asphalt, <br />while other material will be trucked to market by independent haulers. Under expected <br />production rates of approximately 500,000 tons per year, the life of the operation is <br />expected to be approximately 7 years. The actual time frame for the life of the operation <br />is highly dependent on market conditions. <br />Land uses immediately surrounding the property are agricultural in nature. The site will <br />be reclaimed to a lined water storage reservoir facility and a wildlife habitat pond. <br />Heit Sand and Gravel Mine 02044 <br />SW Meadow, LLC February 2003 <br />
