2.03.6 Right of Entry and Operation Information <br />The documents in Volume 4, Tab 1, Documents and Leases, explains the <br />Operators right to mine the coal in the Federal Coal Leases and presents <br />documentation of the Operator's fee coal ownership. The documents in <br />Exhibit 14, Tab 1, explain the Operators right to mine the coal in Federal <br />Coal Lease No. C-0117192. <br />The areas where the Operator currently has the right to mine coal include: <br />Township 13 South, Range 90 West, 6th P.M. <br />Federal Coal Sublease D-052501 <br />Section 17: E'/zNEYa, SW~/aNEYa, SE'/a <br />Federal Coal Lease C-0117192 <br />Section 17: S'/zNW~/a, SWYa <br />Section 18: SEA/aNE~/a, NEB/aSEYa <br />Federal Coal Lease COC57633 <br />Section 20: A parcel of land located in the N~/2 being more particularly <br />described by the documents presented in Volume 4, Tab 1 <br />Federal Coal Lease COC57632 <br />Section 16: A parcel of land located in the WY2 being more particularly <br />described by the documents presented in Volume 4, Tab 1 <br />Bear Fee Coal: <br />Section 18: S'/2SE'/a, All of the coal in the B coal seam occurring north of <br />the stream bed of the Lone Pine drainage, Gunnison County, Colorado. <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />The permit areas are not within an area designated unsuitable for surface <br />mining activities as defined in Rule 7 or 30 CFR 764 and 765, or under <br />study for designation in an administrative proceeding under Rule 7 or 30 <br />CFR 764 and 765. <br />Because the permit area is located within 300 feet of several occupied <br />dwellings in Somerset, Colorado, the applicant has obtained a waiver from <br />the individuals who own or occupy these dwellings.
