Schumacher <br />831 Park Street <br />Sterling, CO 80751 <br />Deaz Mr. Schumacher, <br />Ridge Crest Wind Partners, LLC is the owner of a 29.7 MW wind power facility comprised of 33 wind turbines <br />located in Peetz, Colorado. A number of these wind turbines, including underground cables and access roads, are <br />located on land we sublease in Section 11, Township I IN, Range 52W. Pursuant to our recent conversation, we <br />understand that you plan to establish a gravel pit along the western edge of our D7 access road and south of the <br />40' access corridor running east from County Road 45. We will allow the mining activity to come closer than 200 <br />feet of the access roads and the 40' transmission comdor within the gravel pit boundaries. However, at no time <br />will the pit cross the access roads or our 40' transmission corridor nor come within 200 feet of any existing <br />structure or turbine associated with our wind facility accept for the access roads and the 40' transmission <br />comdor. We also understand that you will; (i) ensure that appropriate dust control measures aze implemented at <br />the gravel pit; (ii) participate in the maintenance of the access roads utilized by your operation; and (iii) reclaim <br />the gravel pit site when the mining operation is complete. We hereby reserve all of our rights and remedies and <br />nothing herein shall be construed as a waiver thereof. <br />Given the representations cited above, we do not believe that the mining and reclamation activities will have a <br />negative effect on our facility. <br />Sincerely, <br />U <br />Timothy O.
