<br /> <br />The Division has received a number of objections to the new permit application. All letters have been sent to the <br />applicant and the consultant in previous correspondence. The concems of the objectors have been incorporated <br />into the Division's adequacy review questions. <br />Under the Conswction Material Rules and Regulations, if objections or concems of a 112 Application or <br />Amendment are received, the Division is required to hold three public meetings. The three meetings are <br />described below. <br />Informal Conference (Rule 1.4.6) The purpose of the informal conference is to identify a]] parties to the <br />proceedings and formal Board Hearings, determine what issues have been resolved (if any), and if there <br />aze additional issues, identify the issues that the Board, by statute, have jurisdiction to address, and <br />explain the hearing process. <br />Pre-hearing Conference (Rule 2.7) The Pre-Hearing Conference will be presided over by the Pre- <br />Hearing Conference Officer. The Pre-hearing Conference Officer is appointed by the Mined Land <br />Reclamation Boazd. The purpose of the Pre-Hearing Conference is to draft a hearing order that lists <br />issues the full Board should consider, lists the witnesses and evidence to be presented by parties, lists the <br />parties that will participate, determine the amount of time afforded each party, and [o resolve any other <br />issues that the Pre-hearing Conference Officer determines is appropriate. <br />Formal Board Hearing (Rule 2.8) The Boazd will conduct the Hearing according to the provisions of <br />the adopted hearing order, the Administrative Procedures Act, Section 24-4-105, Colorado Revised <br />Statutes (C.R.S.), and the Colorado Code of Regulations, 2 CCR 407-4, Section 2.8. The Formal Public <br />Hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or <br />as soon thereafter as the matter can be considered. <br />The Division will contact the applicant, objectors and other interested persons regarding [he meeting dates <br />and time. <br />Please be advised [hat the ]24's Estates Sand & Gravel New 112 Permit Application may be deemed inadequate, <br />and the application may be denied on November 12, 2001 unless the above mentioned adequacy review items are <br />addressed [o the satisfaction of the Division. If you feel more time is needed [o complete your reply, [he Division <br />can grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by November 12, 2001 and request for additional time.
