Long <br />Division Director <br />RE: Adams County RV Pazk, LLC, dba 124's Estates Partners, File No. M-2001-085 <br />124's Estates Sand & Gravel Mine 112 New Permit Application- Adequacy Review <br />Dear Mr. Ewegen, <br />Listed below are adequacy review comments for the l24'" Estates Sand & Gravel Mine New 112 Permit <br />Application, File No. M-2001-085. The Division of Minerals and Geology ("Division") is required to make an <br />approval or denial decision no later than November 12, 2001, therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. <br />As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other <br />qualified person. The maps submitted to the Division were not signed. Please resubmit a signed copy of the <br />maps. <br />Rule 6.4.3 Exhibit C- Pre-Minine and Minine Plan Map(s) of Affected Lands <br />3. Exhibit C-1: Pre-Mine Plan Map (Man Made Features) lists the adjacent property owners. The Division was <br />unable to locate the name and address of property owners to the east of the site and to the north (area north of <br />the site access across 124's Avenue). Please state the name and address of the adjacent land owners. <br />Rule 6.4.4 Exhibit D- Mine Plan <br />The applicant states that a dewatering sump and settling ponds will be constructed within the pit. Please <br />describe the dimensions of the pond, describe any impacts to the surrounding surface water and groundwater <br />systems and state how the ponds will be reclaimed. <br />5. On Page 8, the applicant states that water in the collection pond will be clarified and discharged into the ditch. <br />Please state what ditch will be the discharge point. <br />6. Please state the overall depth of the pit during mining and reclamation. <br />7. The applicant makes note of an existing topsoil pile located on site. Please locate [his pile on the map. <br />
