Dept. of f?atural Resm~rces <br />The State of Colorado <br />Department of Natural Resources <br />Mined Land Reclamation Board <br />Room 723, 1313 Sherman Street <br />Denver, Colorado 80203 <br />RE <br />Gentlemen: <br />• THE <br />Great <br />weSterll <br />Sugar <br />COMPANY <br />January 23, 1979 <br />Jake Kauffman & Son, Inc. <br />Application for Mining and <br />Reclamation Permit <br />On January 23, 1979 representatives of The Great Western Sugar <br />Company and Jake Kauffman & Son, Inc. met in Loveland, Colorado to view <br />the proposed gravel mining site, and to resolve the concerns expressed by <br />Great Western with respect to such mining operations. <br />Because Great Western and Kauffman have entered into a Release and <br />Indemnity Agreement, and because of the representations of Kauffman that a <br />ditch located just inside of and parallel to the Kauffman property line <br />adjoining Great Western's property will not be disturbed or relocated as a <br />result of the mining operations, and that the average depth of the gravel <br />pit will be approximately ten feet, and that the base of the gravel pit <br />will be no closer than thirty feet (measured along the surface and diago- <br />nally down the wall slope), from the property line, Great Western's concerns <br />about this operation have been alleviated. Consequently, Great Western <br />hereby withdraws its December 12, 1978 letter of protest to the Board regard- <br />ing the Kauffman application fora mining and reclamation permit. <br />Sincerely, <br />C-, <br />George E.
