Applicant acquired all the rights and privileges of <br />the Lessee under II. 5. Coal Lease D-044240. U.S. Coal Lease D- <br />044240 specifically grants to the Lessee the right to mine the <br />federal coal and to use so much of the surface as is reasonably <br />necessary is conducting such operations. <br />This lease was relinquished to the U.
