Box 5243
Denver, Colorado 80217
Gentlemen:
`J L.J

ili•!.D Ifii~ D f+~CIC'r:AT10.^! O'~!ISIOi~
You have requested a letter from the City of Lakewood re-
garding the appropriateness of using the property owned and/or
subject to mineral leases by Robinson Brick Company (Robco)
which is located South of West Alameda ?arkway in portions of
Sections 24, 25 and 26, Township 4 South, Range 70 Plest of the
Sixth P.M., City of Lakewood, Jefferson County, Colorado for
mining clay and silica sands. It is the City's understanding
that Robco intends to make application for a mining permit pur-
suant to the provisions of Section 34-32-112 of the Colorado
Revised Statutes.
The southern portion of the above-described property is
zoned Mixed-Use with the extraction of commercial mineral
deposits as a permitted special use. The northern portion, the
surface of which is owned by the City of Lakewood, is zoned
Conservation with the extraction of mineral deposits as a
permitted special use. Based upon information provided by
Robco to the City of Lakewood, however, it appears that Robco
or its predecessor began its mining operation in this area prior
to the incorporation of the City of Lakewood and prior to the
adoption of zoning regulations by Jefferson County in 1996.
Therefore, based upon such facts as represented to the City,
mining for clay and silica sands within the area that has been
owned and/or leased by Robco during this period would constitute
a nonconforming use and, because of the nature of mining, may
be allowed to continue. Thus, the City of Lakewood is not
opposed to such use on the property described.
