<br />You have requested a letter from the City of Lakewood re-
<br />garding the appropriateness of using the property owned and/or
<br />subject to mineral leases by Robinson Brick Company (Robco)
<br />which is located South of West Alameda ?arkway in portions of
<br />Sections 24, 25 and 26, Township 4 South, Range 70 Plest of the
<br />Sixth P.M., City of Lakewood, Jefferson County, Colorado for
<br />mining clay and silica sands. It is the City's understanding
<br />that Robco intends to make application for a mining permit pur-
<br />suant to the provisions of Section 34-32-112 of the Colorado
<br />Revised Statutes.
<br />The southern portion of the above-described property is
<br />zoned Mixed-Use with the extraction of commercial mineral
<br />deposits as a permitted special use. The northern portion, the
<br />surface of which is owned by the City of Lakewood, is zoned
<br />Conservation with the extraction of mineral deposits as a
<br />permitted special use. Based upon information provided by
<br />Robco to the City of Lakewood, however, it appears that Robco
<br />or its predecessor began its mining operation in this area prior
<br />to the incorporation of the City of Lakewood and prior to the
<br />adoption of zoning regulations by Jefferson County in 1996.
<br />Therefore, based upon such facts as represented to the City,
<br />mining for clay and silica sands within the area that has been
<br />owned and/or leased by Robco during this period would constitute
<br />a nonconforming use and, because of the nature of mining, may
<br />be allowed to continue. Thus, the City of Lakewood is not
<br />opposed to such use on the property described.
