III IIIIIIIIIIIII III` <br />999 <br />Exhibit N CIIILRB 112 Permit Application <br />Agile Stone Systems. Inc. <br />Exhibit N Source of Legal Right to Enter <br />• <br />The Applicant owns a purchase option for the affected lands (surface and mineral) as <br />evidenced by the following agreement. In addition the Applicant has obtained a <br />notarized letter from the owners of affected land and substance to be mined providing the <br />Applicant with the Legal Right to Enter the Permit azea. <br />The Applicant has provided both the Union Pacific Railroad (UPRR) and Rock & Rail, <br />Inc. (R&R) with notarized letters allowing them to enter the mining project area with <br />railroad tracks. UPRR currently owns the track and is selling it. They have filed and <br />been granted a discontinuance notice by the Surface Transportation Boazd. The <br />governor's office of economic development and UPRR working together throughout <br />1997 have endorsed R&R to purchase the track from UPRR along with a tourist train <br />operator. R&R is currently completed a Line Sale Agreement with the UPRR to <br />purchase the track and right of way and all assets belong to the UPRR along the entire <br />southern border of the permit azea as well as the azeas to the east and west. <br />• <br />
