[~ <br />Phased Consumation <br />Although the total demand for water will be 63.9 acre-feet, this <br />demand will not be realized until the project is completed. <br />' Since the mining operation will be done using dry mining <br />techniques, evaporative losses will not be replaced until the pit <br />is reclaimed and allowed to refill with groundwater. In <br />addition, the operator will reserve the right to refill mined <br />areas with overburden and topsoil to reduce the total amount of <br />acreage under water. This would also reduce the augmentation <br />obligation to the property. <br />' NPDES Permit and Water Oualit <br /> The proposed operation will directly discharge to the St. Vrain <br />' Creek. This will require a discharge permit through the Colorado <br /> Department of Health. The operator will apply and obtain said <br /> permit prior to beginning operation of the pit. <br /> All wash wate rs that will be used in the processing portion of <br /> the project will be recycled and wi ll not be discharged to the <br /> stream.
