35. Hall-Irwin proposes to dischazge mine water and sediment generated from localized stormwater <br />runoff into the ponds already existing at the previously permitted Baseline Resources pit (M-/997- <br />058). Please further describe how the water will be routed towards the Baseline ponds and provide <br />designs of the predicted flow and structures that will be used to facilitate this runoff. In addition, the <br />operator will be required to revise the mining and reclamation permit of the Baseline pit to account <br />for this additional runoff. <br />Rule 6.4.12 Exhibit L- Reclamation Costs <br />36. The Division will estimate a cost to reclaim the site based on the information submitted in the <br />application. However, the Division has the following questions regarding final reclamation of the site <br />that could not be located in the permit application. <br />• Please list al] structures that will be constructed on site including their composite, dimensions and <br />method of reclamation. <br />• Please estimate the volume of material that will need to be imported to reclaim Phases 1 and 2 <br />above the groundwater table. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />37. Please be aware if the applicant encroaches into any easements as a result of the mining and operation <br />plan, then the applicant must obtain legal right of entry document from the easement holder. Please <br />state what easements will be included, and provide legal right of entry agreements. <br />38. Please locate the area as described in the Kerr-McGee objection letter of Febniary 16, 2006 and the <br />merit Energy Corporation letter dated March 13, 2006. Please further explain how Hall-Irwin will <br />address the impacts to structures and surface use agreements noted in the letters. <br />39. The Division's staff engineer reviewed the stability analysis prepazed by Civil Resources, LLC. <br />Attached is a copy of the Division's review. Please address accordingly. <br />Because objections were filed with the Division, this matter must be set for a hearing before the Mined <br />Land Reclamation Boazd (NLRB). The tentative date for the hearing is May 10-11, 2006. However, the <br />Division will need to make a recommendation by April 17, 2006. Please be advised that Pazker/Dersham <br />Resource application maybe deemed inadequate, and the application may be recommended for denial on <br />April 17, 2006 unless the above mentioned adequacy review items aze addressed to the satisfaction of the <br />Division. If you feel more time is needed to complete your reply, the Division can grant an extension to <br />the decision date. This will be done upon receipt of a written waiver of your right to a decision by April <br />17, 2006 and request for additional time (including a date for consideration before the NLRB).
