45. The engineering demonstration of stability for structures within 200 feet of the affected area is based
upon stability of the slopes at a 3:1 angle of repose. This demonstration shows a mining depth of 42
feet, with the 3:1 slope reaching the permit boundary 125 feet away. Structures are located on or very
near the permit boundary. Therefore, the mining plan and Exhibit S will need to contain a commitment
that mining will, under no circumstances, proceed deeper than 40 feet from the current land surface
elevation. Please insert this commitment wording into the Mining Plan - Exhibit D and Exhibit S.
