The engineering demonstration of stability for structures within 200 feet of the affected area is based <br />upon stability of the slopes at a 3:1 angle of repose. This demonstration shows a mining depth of 42 <br />feet, with the 3:1 slope reaching the permit boundary 125 feet away. Structures are located on or very <br />near the permit boundary. Therefore, the mining plan and Exhibit S will need to contain a commitment <br />that mining will, under no circumstances, proceed deeper than 40 feet from the current land surface <br />elevation. Please insert this commitment wording into the Mining Plan - Exhibit D and Exhibit S. <br />46.
