I am 1/4
owner of the water rights of the =_.pring, and it is the only water
supply for my farm home and livestock.
Since April to present date, there has been absolutely no
blasting, and Jay's stipulations from the Moffat County Planning
Board and the Moffat County Commissioners are for breaF:ing a rock
already er.cavated but to large to get in his trucks. To date
that has not been necessary.
Far your reference, there have been occasions when, due to heavy
rains or er,treme melting of winter- snow the run off from the area
around the spring has (our termin<~logy) muddied the spring water.
Since the Wagner Pit opened :.n April, we had major rains
immediately followed by snow followed by a three inch rain all in
a matter of days. We have not lead even cloudy water indicating
that Jay has ta4;en all precautir~ns for containing any run off
from the pit.
Also, the Moffat County Planning Hoard members came to the Pit
Site before approving the permit. One of the members of the
Hoard has been an employee of the Department of Soil
Conservation. He saw no danger 'to the spring under the blasting
stipulations given Jay.
