Division Director <br />RE: November 96 Board Notes <br />It was a good Board meeting this month, congratulations for a job <br />well done. <br />1. The Board wants to recognize the CMA's 100 year anniversary. I <br />believe Loretta will be working on this. <br />2. In the United Companies case that the Board heard this month, <br />the objectors raised the issue that the applicant had not notified <br />holders of access easement. This requirement is not listed or <br />specifically required in the Rules or directions in the <br />applications. The AGO determined that an easement holder has the <br />same rights as an owner of property. The Board agreed. <br />I am in the process of modifying the permit applications to include <br />notification to holders of recorded access easements. I plan to <br />have the new forms ready for Board approval at the January Board. <br />In the mean time, when you get in a new application, please inform <br />the applicant that they will need to identify easement holders, ID <br />their easements on the property ownership maps, and secure the <br />appropriate right of entry documents as part of the application <br />exRibit. / <br />3. Gunnison County requested two declaratory orders for two <br />existing operations on U.S. Forest Service lands. The mining <br />operations are the result of a cooperative agreement between the <br />County and the Forest Service. The USFS provides the source of the <br />gravel, the County does the mining and maintenance of USFS roads <br />and county roads on USFS lands. No moneys are exchange. No product <br />is hauled or sold off USFS land. The Board agreed to grant the <br />D.O. <br />Bob O. will be contacting the USFS to get copies of their Schedule <br />A county agreements. Once we get those, they will be made <br />available to all teams. I would also like Bob to keep the list <br />96updated annually. <br />
