Division Director RE: November 96 Board Notes It was a good Board meeting this month, congratulations for a job well done. 1. The Board wants to recognize the CMA's 100 year anniversary. I believe Loretta will be working on this. 2. In the United Companies case that the Board heard this month, the objectors raised the issue that the applicant had not notified holders of access easement. This requirement is not listed or specifically required in the Rules or directions in the applications. The AGO determined that an easement holder has the same rights as an owner of property. The Board agreed. I am in the process of modifying the permit applications to include notification to holders of recorded access easements. I plan to have the new forms ready for Board approval at the January Board. In the mean time, when you get in a new application, please inform the applicant that they will need to identify easement holders, ID their easements on the property ownership maps, and secure the appropriate right of entry documents as part of the application exRibit. / 3. Gunnison County requested two declaratory orders for two existing operations on U.S. Forest Service lands. The mining operations are the result of a cooperative agreement between the County and the Forest Service. The USFS provides the source of the gravel, the County does the mining and maintenance of USFS roads and county roads on USFS lands. No moneys are exchange. No product is hauled or sold off USFS land. The Board agreed to grant the D.O. Bob O. will be contacting the USFS to get copies of their Schedule A county agreements. Once we get those, they will be made available to all teams. I would also like Bob to keep the list 96updated annually.
