Small Operators Assistance Program <br />Statement of Agreement <br />I. The undersigned, as duly authorized representative of the Applicant, <br />hereby agrees tnat the Applicant will: <br />1. Cooperate fully with all contracted and subcontracted laboratories <br />that will produce the determination and statement; <br />Z. Su omit coal production information for the area affected by this <br />application and for any otner mining area in which the applicant <br />has an interest (as defined in Section d, item 3 of this <br />application), said information to be furnished witnin thirty (30) <br />days of the end of the first twelve (12) months of inininy activity <br />and tnereafter for each twelve (12) month period for the life of <br />this application; and <br />3. Refund in full the Division of Mined Land Reclamation (hereinafter <br />called the Division) for laooratory services paid for by that <br />ayency pursuant to this application, upon presentation of <br />appropriate receipts, if any of the following conditions occur: <br />a_ Information submitted as required by paragraph (1) above snows <br />coal production to be in excess of lu0,DU0 tons in a <br />twelve-month period; <br />b. No information or false information is submitted; <br />c. wo permit application is suomitted within one (1) year from <br />the date of receipt of the approved laboratory report; <br />d. Tne permit application, for any valid reason, is denied by the <br />Division; or <br />e. The applicant fails to commence mining after ootaining a <br />permit. <br />II. The undersigned, as duly authorized representative of the supplicant, <br />he reoy affirms that the Applicant (including affiliated companies, as <br />specified in Section B, item 3 of this application), has produced no <br />more than 100,uUU tons of coal in the twelve (12) months preceding <br />submission of this application for assistance. <br />III. Tne undersiyned, as duly authorized representative of the Applicant, <br />hereby acknowledges that suumission of the data provided throuyh this <br />assistance as part of the permit application dons not constitute <br />unconditional or prior approval of any permit application containing <br />said oat a. <br />
