STATE OF COLORADO
DIVISION Of MINERALS AND GEOLOGY
Department of Natural Resources
1313 Sherman St, Room 215 C O L D RA D O
Denver, Colorado 80203 DIVISION O F
Phone: (303) 8663567 M I N E
RA L S
~
FAX: 1303) 832-8106 G E O L O G Y
RE CLANATION•NININO
SAfETY•SCIENCE
Bill Owens
Governor
Russell George
7 June 2005 E><eclnive Director
Ronald W. cottony
Mr Jeny Nettleton Division Director
Twentymile Coal Company NaNral Resource Trustee
29515 Routt County Road 27
Oak Creek CO 80467
SUBJ: NOI CX-2005-205-10; Incompleteness Letter
Deaz Mr Nettleton:
The Division has received your Notice of Intent to conduct coal exploration
(NOI-2005-205-10), submitted 31 May 2005, and has made the following findings:
1. The application is incomplete.
2. The project qualifies as coal exploration rather than coal mining.
3. Your project will substantially disturb the natural land surface. Therefore you will be
required to submit a bond to cover the cost of reclamation. The Division has received
your estimate and is calculating one at the moment. A copy of the detailed estimate
will be forwazded to you when it is complete.
As we have discussed on the telephone, there aze two minor items item required to make
your application complete. One is the status of the updated right-of--entry information
from the surface owner. With an agreement with the Cross Mountain Ranch that expires
at the end of July, the Division can approve the NOI with a period of performance that
lasts only till the end of July. It can then be extended when the new agreement is
received by the Division.
The second issue is the status of a cultural survey over two azeas -the NE '/a of the SE %a,
section 5, TSN, R86W and the SE'/4 of the NW %., section 26, TSN, R87W. Your
explanation that these azeas may occupy ground that is cultivated is acceptable, but
should be documented in out correspondence.
The Division is in the process of calculating a bond liability estimate for this notice of
intent and will notify Twentymile Coal Company by the end of the week as to the total
that will be required.
Office of Office of Colorado
Mined Land Reclamation ARive and Inactive Mines Geological Survey
