Wei lit of Coal--It is agreed that all coal mined and taken from said premises <br /> shal be welghe and the weight thereof shall be entered in due form In books of <br /> weight records kept for such purposes by lessee. <br /> It is agreed that the term "ton" as herein used means a ton of 2000 pounds <br /> of merchantable coal as shown by coal miners' payroll check number or official <br /> railroad scale tickets• or by weight determined at the mine tipple, or by weighto- <br /> meter; provided that where lessor determines that it is not possible accurately to <br /> determine the weight by such means it may. by its duly authorized agent or <br /> agents, elect to compute a ton of coal at twenty-seven cubic feet of coal in the <br /> solid or by the measurements of the space from which the coal Is mined, deduct- <br /> - - Ing therefrom all space occupied by slate or other Impurities, and in such case <br /> the said computation shall be final and binding upon the lessee. <br /> 5. Reports--After operations are begun, it Is agreed that on or before the <br /> twenty fifth day of each and every month during the term of this lease the lessee <br /> shall make a sworn report to the lessor, in which shall be entered and set down <br /> the exact amount in weight of all coal mined and removed from said premises and <br /> sold during the preceding calendar month, which report shall show the amount of <br /> work performed during the preceding calendar month; and said lessee shall also, <br /> during the term of this lease, make a sworn statement to the lessor disclosing <br /> the number of tons of all coal mined and removed from the premises during the <br /> preceding six-month period, and shall make such semi-annual statements on the <br /> twenty-fifth day of each sixth month of the term of this lease. Further, lessee <br /> shall furnish annually a map or blueprint of survey of all workings, showing <br /> depths and thickness of coal, with Iocation of same tied to a corner established <br /> by United States surveys of some land subdivision, certified to by a licensed <br /> engineer or surveyor as provided for in Colorado Mining Code of the State of <br /> Colorado. <br /> S. Inspection--It is agreed that during all proper hours and at all times during <br /> • the continuance of this lease the lessor or its duly authorized agent or agents, <br /> shall be and hereby is authorized to check scales as to their accuracy, to go <br /> through any of the slopes, entries, shafts, openings, or workings on said prem- <br /> ises, and to examine, inspect, survey and take measurements of the same and to <br /> examine and make extracts of copies of all books and weight sheets which show <br /> In any way the coal output of the leased premises, and that all conveniences <br /> necessary for said inspection, survey or examination shall be furnished to the <br /> lessor. <br /> T. Mining Methods--In the underground and open pit workings, all shafts, to- <br /> clines and tunnels shall be well timbered (when good mining requires timbering) <br /> and all parts of workings, where coal Is not exhausted, will be kept free from <br /> water and waste materials as in ordinary operations. The underground and open <br /> pit workings shall be protected against fire, floods, creeps and squeezes. If <br /> such events do occur, they shall be checked In a manner which is in keeping with <br /> good methods of mining. Such methods of mining shall be used as shall Insure <br /> the extraction of the greatest possible amounts of coal consistent with prevailing <br /> good mining practice. <br /> Lessee agrees to slope the sides of all surface pits or excavations to a <br /> ratio of not more than one foot (I') vertical for each two feet (2') of horizontal <br /> distance. Such sloping shall become a normal part of the operation. Whenever <br /> practicable, all pits or excavations shall be shaped to drain, and in no case <br /> shall the pits or excavations be allowed to become a hazard to persons or live- <br /> stock. All material mined and not removed from the premises shall be used to <br /> fill the pits so that at the expiration, surrender, or termination of this lease <br /> the land will, as nearly as practicable, approximate its original configuration, <br /> with a minimum of permanent damage to the surface. <br /> 8. Rights of Way--It is agreed that the lessor reserves the right to grant <br /> rights of way over said premises for public roads, railroads, power. <br /> telegraph, telephone, ditch and canal lines, but such grants shall be so made as <br /> not to lnterferc with the operations of the lessee. <br /> .
