McCurdy `~ <br />CityPlace One, Ste.300 <br />St. Louis, Missouri 63141 <br />Coal Lease Issued <br />Bond & Rider Accented <br />On Iuly 1, 2004, Ark Land Company submitted the high bid at the Colorado State Office competitive coal <br />lease sale for 690.95 acres identified as serial number COC 67011, As conditions for lease issuance, Ark <br />Land Company (I) executed four copies of the lease, (2) submitted the fast yeais rental and a payment <br />for advemsing the coal sale, (3) filed a lease bond in the amount of $156,000, and (4) filed the <br />information required for antitrust review with the BLM on July 23, 2004. <br />• The $156,0001ease bond no.1007288 having Ark Land Company as principal and Lexon Insurance <br />Company, as surety, was received on the same date. A rider decreasing the bond amount to $41,000 was <br />filed August 5, 2004, having Ark Land Company as principal and Lexon Insurance Company as surety. <br />The bond and rider have been examined, found satisfactory, and are hereby accepted effective <br />September 1, 2004. <br />All starutory and regulatory requirements having been met, coal ]ease COC 67011 is hereby issued to Ark <br />Land Company effective September 1, 2004. <br />Karen A.
