Long <br />Drvaion Director <br />RE: Register of Historic Places Act-Petition <br />to Board of Mined Land Reclamation, Moffa <br />Cross Mountain Pit #1, Permit M-93-023. <br />Dear Mr. Hartman: <br />for Declaratory Relief <br />t County as petitioner, <br />On December 14, 1994, the Mined Land Reclamation Board continued the <br />hearing on the Petition for Declaratory Relief referenced above which <br />was received by the Division of Minerals and Geology on December 5, <br />1994. The item was continued to the February Board meeting to allow <br />the Division to properly notice all parties in this case that may be <br />affected by the Board's decision. The other reason for continuance <br />was to allow the Colorado Historical Society to obtain a Colorado <br />Attorney General opinion on the applicability of the Register of <br />Historic Places Act to this particular case. <br />This letter will serve as notice that a formal public hearing will be <br />held during the February 22-23, 1995 meeting of the Board to decide <br />whether to grant Moffat County administrative relief from the permit <br />condition placed upon Permit M-93-023 and/or to change the Division's <br />policy regarding conditioning of permits in this regard. The hearing <br />will be held in Room 318 of 1313 Sherman Street, Denver, Colorado <br />starting at 9:00 a.m. At that hearing, you will have the opportunity <br />to appear and/or be represented by counsel in this matter. <br />If you have any questions, please contact me. <br />Sincerely, <br />Carl B.
