Hernandez <br />Dear Mr. Hernandez: <br />~ III IIIIIIIIIIIIIIII <br />DECEIVED <br />APR 2 ~ 1991 <br />Mined Land <br />Reclamation Division <br />Douglas County is in receipt of your April 17, 1991, letter concerning a notice of public <br />hearing for Centennial Materials Inc./Winkler Light Aggregate Quarry, File #M89-065. <br />The letter notifies Douglas County that Centennial Materials Inc. is proposing to post a <br />$295,850 financial warranty for the Winkler Light Aggregate Quarry. The letter eludes to <br />the fact that the financial warranty was not posted by the permit holder within the one <br />year allowed period of time and thus requires a public hearing before the MLRB before <br />acceptance. <br />The purpose of this letter is to notify the MLRB that Douglas County does not have an <br />active special use application for the above mentioned quarry under the name of <br />Centennial Materials. We do have an inactive and unapproved special use application <br />called Winkler Light Aggregate Quarry, Project File #US89-007. Our concern is that a <br />special use permit will be required by the Board of County Commissioners of Douglas <br />County prior to any mining activity. Also, we are concerned that the reclamation plan that <br />was approved in 1989 may not be consistent with the recently adopted Douglas County <br />Master Plan for Mineral Extraction as far as any visual amenities and traffic impacts are <br />concerned. <br />It would seem appropriate that the State withhold any approval of permits for mining <br />activities until such time as a special use application has been submitted, processed, and <br />decided upon by the Douglas County Commissioners. We realize that reclamation permits <br />can be obtained from the State prior to County zoning processing, but nevertheless, it is <br />clear that local zoning must be complied with at some point. There are a great number <br />of residents in the greater Franktown area that are very concerned about this proposal <br />and surely will have input into the mining and reclamation plan, therefore, their input <br />could be valuable if solicited first before you decide on a reclamation plan that might be <br />inconsistent with their concerns and those of the County. <br />Planning Division.
