State Reg. ------- ~-- -- <br />• ~ _ Golden Bogle nests around the periphery of the permit ores will not be <br />disturbed by mining activities. Powerlihes will be constructed as per <br />federal and state criteria to minimize the danger of electrocution by <br />perching birds. The development of a herbaceous community will in- <br />crease the ease of hunting by eagles and other raptors in the area. <br />No other threatened, endangered, or protected species have been seen on <br />the permit area. However, if, during the course of mining, a protected <br />species is detected, the proper regulatory agency(ies) will be immedi- <br />ately,informed and consulted to determine the best course of action. <br />Monitoring programs for vegetation and wildlife will be continued with <br />consultation of the regulatory authority as the most direct means of <br />early identification of protected species. <br />C. General Wildlife Protection Procedures. As further protection of the <br />wildlife resource during and after mining, the following actions will be <br />• taken: <br />I. Fencing of active mining areas will be with consultation of the regu- <br />latory authority to minimize effects on migration routes of elk during <br />mining and minimize incidental intrusion into active mining areas. <br />2.. The revegetation seed mixtures for the drainage courses were de- <br />signed to specifically maximize the growth potential of moist areas. <br />3. There have been no toxic water problems at Seneca II from which <br />wildlife must be protected. If such should occur, fencing to exclude <br />wildlife from the affected area will be accomplished and remedial action <br />to eliminate the problem will be taken. <br />4. Pesticides will be used only on the area during mining or reclamation <br />in accordance with the County Commissioners and the Colorado <br />• Pesticide Act. <br />5. Access to the entire permit ores is and will be controlled to limit <br />unauthorized trespass. <br />Revised 5-27-81 <br />
