M-2003-016. <br />THIS MATTER came before the Mined Lands Reclamation Boazd ("Boazd") on <br />September 24, 2003 in Denver, Colorado for a hearing on the Section 112c application <br />for a reclamation permit by SW Meadow, LLC ("Applicant"} in accordance with C.R.S. <br />§ 34-32.5-114. Robert Bruce, Esq. appeared on behalf of the Applicant. Objectors Robert <br />and Lavenia Temmer, and Neil and Laura Coyle appeazed on their own behalf. Kate <br />Pickford appeazed on behalf of the Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been <br />otherwise fully informed in the premises, hereby enters the following findings of fact, <br />conclusions of law and order: <br />1. The Applicant seeks a Section 112c reclamation permit fora 102 acre surface sand <br />and gravel pit known as the Heit Pit located in Section 13, T2N, R67W, 6th P.M., <br />Weld County, Colorado. <br />2. The proposed permit area is located west of the South Platte River, three miles from <br />Fort Lupton. The Applicant proposes a mining disturbance of approximately sixty- <br />one acres. The proposed post-mine land use is a reservoir. The Applicant proposes <br />to construct a slurry wall around the pit, de-water the pit during mining, and discharge <br />the water into the South Platte River. The proposed pit would average twenty-six feet <br />in depth. <br />
