COLORADO
80631
September 19, 1977
~~
TELEPHONE
f 3031 353 1292
RECEIVED
SEP 21 1977
Colorado Mined Land Reclamation Board
1313 Sherman Street
Denver, Colorado 80203
Re: Application of Hazeltine Investment
Section 3, and the N~ of SE$ of Sec
Range 67 West of the 6th P.M., Adams
Gentlemen:
MINED LAND RECLAMATION
Colo. Dept. of Natural Resources
Association - NW$SW$ of
lion 4, Township 2 South,
County, Colorado
We wish to file these written objections to the above application,
the objections being made on behalf of Emily K. Ferguson, the owner
of land adjoining the proposed gravel pit directly to the south. Mrs.
Ferguson's objections to the application are as follows:
1. Lateral support - Adequate protection must be afforded Mrs.
Ferguson's property so that all mining and gravel pit operations have
a sufficient setback from the boundary line so as to afford complete
lateral support from subsidence and other problems of gravel extrac~
lion as they might affect Mrs. Ferguson's property.~Her experience
on a gravel pit operation to the south of her property showed that the
powerful sucking devices used in the dredging operations did in fact
cause subsidence in the land and holes to appear in Mrs. Ferguson's
field from the fact that this gravel was sucked out at such a depth
and distance as to affect her. Mrs. Ferguson's experience with the
type of gravel layers involved with regard to the dredging operations
south of her property indicated that the effect went into her field
from the point of extraction of the gravel, a distance of 300 feet;
therefore, a distance in excess of 300 feet should be provided for
lateral support
2. Water levels and augmentation - It is assumed that the State
Engineer will require augmentation to be provided to the South Platte
River for the evaporation and other water loss arising from the gravel
operations, and the existence of an open body of water.~Since this
operation will be carried on downstream to the north of rs. Ferguson's
property, the water table, with all of the exposure of the water table
to the surface due to the excavation of gravel, will cause a lowering
of the water table in Mrs. Ferguson's property, thereby lowering the
water level in three irrigation wells and to four domestic wells and
three stock wells. If this water level is drawn down by the gravel
operations, it will require the deepening of the existing wells on Mrs.
Ferguson's property. Conditions must be imposed for the protection
of Mrs. Ferguson as to how this particular activity will relate to
her problems.
~ iiiiiiiiiiiiiiiiiii
