• -43- • <br />Obernyer: Right. It's certainly an argument, I'm trying to think of the <br />case...our situation is so different from the cases that have <br />been decided. Most of the cases that I'm aware of, the two <br />cases I'm aware of, Colorado proposed with the PUC and they, <br />of course, can make findings based upon the health, safety <br />and welfare of the people in the state. It certainly could <br />be argued, I just would hate to go out and limit it. I can't <br />assure you that a court would buy it. <br />
