That's what you're saying. <br />No. The '76 statute.... <br />Okay, beginning July 1, '76. <br />Yes. A lot of days have passed since then. (I mean) you're <br />talking about a crippling ability to fine, and cease and desist <br />order is another very, very heavy lever. Those are the areas <br />where you may have some discretion based on whatever the AG <br />advises you. But in this area you don't-and frankly, through <br />legislature's policy I think its very clear and very sensible. <br />If you go ahead and ignore 120, give permits to operators who <br />have not yet brought the total operation into compliance, the <br />fact that this operator is being a good sport and is filing <br />applications, albeit incomplete, and the staff is not certain <br />whether they cover all the operator's operations, approximately <br />12, I believe is the phrase, other operators are not going to be <br />good sports if they see that one of your most clear enforcement <br />tools is going to be waived by you on a case by case basis. The <br />best thing I think to do in conclusion, if I may make a suggestion, <br />is to stick to the strict letter of the law, 120 and 115, like <br />the legislature is telling you to do, but to encourage operators <br />to get their total operations in. There may be burdens on the <br />staff, but the burdens in the long term, I think, are going to <br />make considerably less if you enforce the law. <br />
