• -19- •
violations of state Land Reclamation laws have not been rectified.
This means, for example, that the permit cannot be issued if an
operator is currently mining without a permit or if he has not
filed (and/or) obtained approval of the land reclamation plan
and bond for acreage which was mined without a permit. The same
applies to any other lack of compliance with past or currently
effective land reclamation statutes, and it was my understanding
at the last Board meeting that there would be information
presented on this question to the Board before you place your
decision of actually granting approval or denial of this permit.
Ward: Okay. Is there evidence that there is operation without permit?
Obernyer: I would say that's within the staff's, Rade's actually made the...
on-site visitation.
Drell: I've inspected approximately S of Nielson's applications for
Nielson's pits, and I can't say that they are not working. I
can't say that they are. During my inspection there was no sign
of any type of mining equipment other than working off the stock-
piles and loading trucks, but actually really mining,I did not
see them mining. That's all I can, as far as I can see from what
I saw.
hard: Stockpiles from previous mining?
Drell: Yes, which I assume was done last year at the beginning of the
summer, last spring.
