• -19- • <br />violations of state Land Reclamation laws have not been rectified. <br />This means, for example, that the permit cannot be issued if an <br />operator is currently mining without a permit or if he has not <br />filed (and/or) obtained approval of the land reclamation plan <br />and bond for acreage which was mined without a permit. The same <br />applies to any other lack of compliance with past or currently <br />effective land reclamation statutes, and it was my understanding <br />at the last Board meeting that there would be information <br />presented on this question to the Board before you place your <br />decision of actually granting approval or denial of this permit. <br />Ward: Okay. Is there evidence that there is operation without permit? <br />Obernyer: I would say that's within the staff's, Rade's actually made the... <br />on-site visitation. <br />Drell: I've inspected approximately S of Nielson's applications for <br />Nielson's pits, and I can't say that they are not working. I <br />can't say that they are. During my inspection there was no sign <br />of any type of mining equipment other than working off the stock- <br />piles and loading trucks, but actually really mining,I did not <br />see them mining. That's all I can, as far as I can see from what <br />I saw. <br />hard: Stockpiles from previous mining? <br />Drell: Yes, which I assume was done last year at the beginning of the <br />summer, last spring. <br />
