Cottony <br />/ Acting Division Director <br />Re: Ghost River Gravel Pit, File No. M-2003.002, Receipt of 110 Construction Materials Reclamation Permit Application <br />Package <br />Deaz Mr. Gagliano <br />On January 21, 2003, the Division of Minerals and Geology received additional materials to your 110 Constmc[ion Materials Reclamation <br />Permit Application package for [he Ghost River Gravel Pit, File No. M-2003-002. Preliminary review of the information-received <br />determined that the following items must be~received before the Division can consider your application as being submitted andtechnical <br />review can begin: <br />F.XHF{tIT i. -Permanent Man•Made .Cfn,rhmnc (u„Ie F.'t.12t, you must provide information sufficient to demonstrate that <br />[he stability of any structures located within two hundred (200) feet of [he operation or affected land will not be adversely <br />affected. If the Once determines that such infomtation is inadequate ro demonstrate that the operation wiIl not adversely affect <br />the stability Of any significant, valuable or permanent man-made structure, the Applicant shall either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest in the strrcture, ~. <br />[hat [he applicant is to provide compensation for any damage to the stmcture; or <br />(b) where such an agreement can not be reached, the apphcant shall provide an appropriate engineering <br />evaluadon that demonstrates that such stmeture shall not be damaged by activities occurring at the mining operation. <br />Your application will not be considered filed until the inforrnadon listed above is received and found sufficient to be$ti our review. A <br />decision date wi4 be established 30 days from the date of receipt of all of the requested information. Additionally, if you have atready <br />published notice you will need to republish notice, after the Division considers the application submitted. Republication must occur once <br />within ten (10) days of the submittal date. We wilt notify you when you should inifiate repubiication of your notice. The 6na1 date for <br />receiving comments is ten (10) days after the date of publication or the next regulaz business day. <br />You have sixty (60) days from [he above date to submit all necessary documents that the Office needs for an application ro be considered <br />filed. If, at the end of the sixty day period, the application has not been determined to be filed with the Office, the Office shall deny [he <br />application and terminate [he application file. <br />This letter shalt not be construed to mean that there aze no other technical de5ciencies in your application.
