KUIPER
State Engineer
TO: HARRIS D. SHERMAN, SECRETARY, MINED LAND RECLAMATION
FROM: DR. JERIS A. DANIELSON, DEPUTY STATE ENGINEER
SUBJECT: COTTER CORP. - JD-6 MINE, MONTROSE COUNTY, REVIEW OF
ADDITIONAL INFORMATION
As requested by your office, we have reviewed the information provided in
the letter of November 21, 1977 from Holme Roberts & Owen. This letter
implies that water rights are required only if the use of available water will
injure other water users. Colorado statutes, specifically CRS 1973, 37-90-
137(4), provides that beneficial use of even non-tributary ground water is
subject to administration even when no injury will occur. Our Ground Water
Section has determined that Cotter Corporation should submit a well permit
application to our office for the amount of water being utilized. If this
requirement is met by the applicant, we recommend approval of the appli-
cation.
w ~ .
A. Danielson
JAD/SSH:mvf
cc: Ralph Kelling, Div. Eng.
