DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: COTTER CORP. - JD-6 MINE, MONTROSE COUNTY, REVIEW OF <br />ADDITIONAL INFORMATION <br />As requested by your office, we have reviewed the information provided in <br />the letter of November 21, 1977 from Holme Roberts & Owen. This letter <br />implies that water rights are required only if the use of available water will <br />injure other water users. Colorado statutes, specifically CRS 1973, 37-90- <br />137(4), provides that beneficial use of even non-tributary ground water is <br />subject to administration even when no injury will occur. Our Ground Water <br />Section has determined that Cotter Corporation should submit a well permit <br />application to our office for the amount of water being utilized.
