CO 80203 <br />Subject: Adequacy Review Response, Application for Regular 112 Permit, <br /># M-99-120, Fort Lupton Sand and Gravel Mine <br />Dear Erica: <br />We are writing to ask for an extension to the decision date of March 27, 2000. We need additional <br />time to provide adequate response to your second adequacy review. <br />We must state for the record that we received your faxed letter (without any attachments) on Friday <br />morning, March 24, 2000. Receiving the review letter one business day before the deadline <br />prohibited us from having adequate time for response to your review. Also, we did not receive a <br />copy of the Memorandum of Understanding between the DMG and the State Engineer regarding <br />slurry walls, et al, with your faxed letter, but instead late In the day. This information could have <br />been presented to us at a much earlier date, which may have allowed us adequate time for <br />response. <br />Please be advised that by our request for an extension, we.in no way acknowledge the Division of <br />'Minerals and Geology's authority to regulate construction o~ slurry walls. <br />We can, at this time, respond to Question 1, regarding the proposed access road. The access <br />road will be reclaimed. It will not remain as part of the post-mining land use. <br />Questions 2, 3, and 4 will be answered under separate cover. In order to provide the DMG with an <br />adequate response to these questions, we require additional time. <br />In response to Question 5, we have four out of eight agreements signed and notarized. Copies of <br />these four agreements are attached. <br />Please note that our responses to Questions 2, 3, and 4 (under separate cover), will be the final <br />time we address adequacy issues with you regarding this application. We should not be subjected <br />to any new adequacy issues, and if any should arise, we will respond directly to the Board. <br />Please advise me in writing of the deadline for the time extension.
