Dept. of Natural Resource:
Pursuant to our telephone conversation this morning, please
find enclosed a copy of the Findings and Resolution concerning the
special review petition of Three Bell Ranch Associates. Because the
approval is conditioned upon submission of a hydrological study and
road improvement plan, excavation may not commence until these items
are submitted and approved.
The County Attorney explained that there will probably be two
different court cases filed against the County Commissioners concerning
their action on the Special Review petition. Three Bells Ranch Associates
have already filed suit because the asphalt and concrete batch plants
were excluded from the approval. A court date has not been set for this
matter.
The persons who objected to the Special Review have also expressed
their intention to file suit to have the approval over turned. This suit
has not been filed but they have 30 days from the date the resolution was
signed {18 December 1979).
If you have any questions or need additional information, please
contact me at your convenience.
Sincerely,

Al Kadera
Assistant Zoning Administrator

LARIMER
JAN - 8 1980
CC: file
Encl.
iii iiiiininmiii •
999
