Section 785.19 (e) Continued. <br />• (4) For the purposes of this paragraph, a farm is one or more land <br />units on which agricultural activities are conducted. A farm is gen- <br />erally considered to be the combination of land units with acreage and <br />boundaries in existence prior to August 3, 1977, or, if established <br />after August 3, 1977, with those boundaries based on enhancement of the <br />farm's agricultural productivity and not related to surface coal mining <br />operations. <br />Kerr Coal was producing commercial quantities of coal at the exist- <br />ing Marr Mine and Kerr Tipple prior to August 3, 1977. This fact <br />is documented in Colorado State Mining and Reclamation Permit <br />76-13, and in Table 1, Historical Production Rates, <br />A material damage analysis has been performed and is presented in <br />Section 785.19 (d). As documented by this analysis, no material <br />damage to the quantity and quality of water in surface and ground <br />water systems that supply alluvial valley floors will occur due to <br />operations in the mine plan or tipple areas. The characteristics <br />supporting the essential hydrologic functions of the acknowledged <br />alluvial valley floors in the adjacent area will not be adversely <br />affected. Thus, the significance of impact from the proposed <br />operations on farming will be minimal, and there will be no inter- <br />ruption, discontinuance, or preclusion of farming on any of the <br />acknowledged alluvial valley floors. The material damage analysis <br />was performed in accordance with the provisions of 30 CFR 785.19 <br />(e)(3). A continuing environmental monitoring program will ensure <br />the prevention or detection of possible material damage, and the <br />comprehensive water quality control program and reclamation plan <br />described in Section 784.21 will ensure mitigation of any adverse <br />impact. Performance standards and proposed compliance measures for <br />operations adjacent to alluvial valley floors are presented in Part <br />822 of this application. <br />r , <br />785-46 <br />
