Dear Mr. Rogers:
The Division of Minerals and Geology has received written comments concerning the above referenced
application. The comments technically constitute an objection to the application. However, a review of
the issues being put forth, appear to be non jurisdictional or are being covered under the normal review
process. The 110c process is such that the objectors must appeal a decision by this Office directly to the
Mined Land Reclamation Board within 30 days of staffs decision per Rule 1.4.11(1)(b). If no appeal
request is received, staff's decision will stand. DMG staff will make a decision based on the appropriate
date set by Rule.
Please find enclosed copies of fhe comments received and staff's response to the commenter. The
Division request that you direct responses to this Office. Those responses will then be forwarded on to
the commenter with any appropriate Division responses if necessary. As noted in staff's response, most
issues appear to be non-jurisdictional or are being addressed within the normal review process. A
formal response to the comments is required however.
The receipt of comments does not affect the review time of the application of a 110c. Please remember
that the Division needs the submittal of the amendment to add the haul road or and Decision Date
extension request by the applicant by March 16`h, 2006.
