The Pemrittce, Robins Constmdion Co. LLLP desires to conduct a minurg c~reration lmown as <br />Robins Pit No. 1, for the purpose of extracting gravel. The Pemtittee will not mine any secondary commodities. <br />B. On May 10, 2002 the Mined Land Reclamation Board (the "Board") approved the Perrnittee's <br />application for this permit, fixed the amount ofthe financial warranty and directed that this pemut be issued upon <br />.the Sling with the Division of Minerals and Geology (the "Division") of performance warranty and financial <br />wamauty (or wartanties) in die amount so fixed in form and substance approved by the Division. Said warranties <br />have been filed with the Division. <br />C. If the Pemrittee desires to extract materials other than those fisted in (A), a separate permit may <br />be required. <br />D- On May 10, 2002 the Board made the following findings: <br />1. The application for this pemrit complies widr the requiremarts of the Colorado Mined <br />Land Reclamation Act forthe Extraction of Constmction Materials, C.RS. 34-32.5-101 et ~., as amended, and <br />with all applicable local, state and federal laws; <br />2. The aeration will not adversely affect the stability of any significant, valuable, and <br />pemranerrt man-made stmcgrre located within two hundred feet. of the Affected Land, exert where there is an <br />agreemant between the Operator and the persons Iravmg an interest in the stmcture that damage to the stmcture is <br />to be compensated for by the Permittee; and; <br />
