w <br />~.03 Introduction and Summary <br />The Apex #2 Mine was operated by Sunland Mining Corporation since 1976 and is a <br />pre-law site. The site also contains a much older mine called the Apex #1 Mine. <br />Sunland Mining Corporation permitted the site in the late 1970's, however, the original <br />permanent program permit application was submitted on February 4, 1981 and was <br />approved in March of 1983. The permit was fully issued to Sunland on March 26, 1983 <br />fora 5 year term. Sunland operated the mine until late 1985. On January 26, 1986, the <br />mine was placed in temporary cessation, which continued until the fall of 1992. At this <br />time the mine was permanently reclaimed. <br />All mine structures, buildings and facilities were removed from the site with the <br />exception of the shop building which has been left for the landowner. All mine portals <br />have been fully sealed and all areas have been fully backfilled and graded according to <br />the approved reclamation plan. The total surface disturbed area was 3.1 acres. Topsoil <br />was placed on the reclaimed area and the site was reseeded and mulched in November <br />of 1992. <br />Phase 1 bond release was initially applied for in late 1992 but was withdrawn due to <br />problems with the DMG's pre-law highwall regulations. Since the reclamation plan for <br />the Apex #2 Mine provided for partially leaving apre-law highwall, the application <br />was withdrawn until the DMG could revise its pre-law highwall regulations with the <br />OSM. This was eventually done and the application for Phase 1 bond release was re- <br />submitted in the fall of 1995. The site visit also occurred in the fall of 1995. The <br />DMG approved the bond release in January of 1996 and the OSM concurred in <br />February of 1996. This reduced the original bond amount from $172,020 by $103,212 <br />to a current amount of $103,212. <br />The sediment pond and ditch system has been left in place and will remain until the <br />revegetation of the site has been approved. <br />The 1st permit renewal occurred in 1987. The 2nd renewal occurred in 1993 and the <br />third renewal has been submitted in November of 1997.
