Change in Discharge <br />All discharges authorized herein shall be consistent with the terms and <br />conditions of this permit. The discharge of any pollutant identified <br />in this permit more frequently than or at a level in excess of that <br />authorized shall constitute a violation of the permit. Any anticipated <br />change in discharge location and/or facility expansions, production <br />increases, or process modifications which will result in new, different, <br />or increased discharges or pollutants must be reported by submission of a <br />new NPDES application or, if such changes will not violate the effluent <br />limitations specified in this permit, by notice to the State Nater <br />Quality Control Division of such changes. (See PART III, paragraph A.i on <br />Page 12 of 15 for additional requirements.) Process modifications include, <br />but are not limited to, the introduction of any new pollutant no[ previously <br />identified in the permit, or any other modifications which may result in a <br />discharge of a quantity or quality different from that which was applied for. <br />Following such notice, the permit may be modified to specify and limit any <br />pollutants not previously limited. <br />2. Noncompliance Notification <br />• a. If for any reason, the permittee <br />comply with any maximum discharge <br />this permit, the permittee shall, <br />Control Division and EPA with the <br />subparagraph b: <br />does not comply with or will be unable to <br />limitations or Standards specified in <br />at a minimum, provide the Water Quality <br />following information as specified in <br />(1) A description of the discharge and cause of noncompliance; <br />(2) The period of noncompliance, including exact dates and times and/or <br />the anticipated time when the discharge will return to compliance; <br />and <br />- (3) Steps being taken to reduce, eliminate, and prevent recurrence . <br />of the non-complying discharge. <br />b. (1) In the case of any discharge subject to any applicable toxic pollutant <br />effluent standard under s307(a) of the Act, the information required <br />by subparagraph a. Above regarding the violation of such standarC <br />shall be provided within 24 hours from the time permittee becomes <br />aware of the circumstances. If this information is provided orall}•, <br />a written submission covering these points shall be provided a+ithin <br />five days of the time the permittee becomes aware of the circumstances <br />covered by this paragraph. <br />- (2) In the case of other discharges which would constitute a threat to <br />• human health, welfare, or the environment, including discharge <br />containing. pollutants described in s311 of the Act or pollutants <br />which could cause a threat [o public drinking water supplies, the <br />information required by subparagraph a.
