RE: Final Adequacy Letter, Roaring Fork Resources, Mamm Creek Application, No. M-2000-113 Deaz Mr. Balaz: In previous correspondence, the Division of Minerals and Geology (or DMG) provided you with two adequacy review documents, concerning Hydrologic Issues and Geomorphic Stability Issues, for [he above-referenced applicati~m. Issues that were not addressed included wildlife, threatened and endangered species and the Heron rookery located within the proposed permit boundaries; The Division faxed you a copy of the November 5, 2000 Division of Wildlife (DOW) comments on this application. We consider these comments to be an appropriate adequacy review for the wildlife issues. In this letter, it was suggested that the renewable resources area could be downsized allowing a greater buffer between the disturbance azea and the heron nesting area. The DMG suggests that limiting the time of disturbance in this area, to avoid activities during the time that the nesting birds are using the rookery, could be an alternative to a lazger buffer azea. Please respond to the DOW's comments and our sugges[ion about seasonal time limits in this area. It is the Division's understanding that you will meet with the U. S. Fish and Wildlife Service (USF&W), to discuss the threatened and endangered species situation at the proposed operation, and that the Division of Minerals and Geology might a[tend this meeting. The Division requests that you commit to notifying us of any requirements from the USF&W, because such requirements may affect the mine or reclamation plan, permit requirements or the financial warranty requirements. The Division requests that you submit your adequacy review responses by December 22, 2000. This will give [he City of Rifle, which has reques[ed "party status" as a forma] objector, some [ime to review your information prior to the Informal Conference meeting. At this time, the Division tenta[ively plans to hold this conference in Rifle on January 4 or 5. 2001. In order for this application to be heard at the January 24-2~, 20001 Board Meeting, the Division must make its recommendation to the Board by January 8, 2001. If the recommendation is made on that date, the Pre-hearing Conference will he held on January 16, 2001.
