VI, PROT ~ .TION t7F PR'F,MISBS <br />Lessee agrees to maintain at its Cost existing fencing and gates. Gates wi11 be kept, <br />locked during the hours of darkness and at all times when the Leased Property is not <br />occupied by Lessee's personnel. <br />V1I, PAYIrtEI~i'J' QF TAXES <br />Lessor agrees to pay all zeal estate taxes Ievied against the Leased Property before <br />they become delinquent. In the event that the Lessor fails to pay the taxes, Lessee may, at its <br />option, pay any taxes and assessments that maybe levied against the Leased Property and <br />deduct the amount of tax payments, together with any penalties or interest required to be <br />paid, from any amount due or to become due to Lessor. <br />VIII. R~MOVALOF IMPTtO~BMENTS AND ~,Q1~IiPMENT <br />All improvements and equiprent placed on the Leased Property by Lessee shall <br />amain the property of Lessee, and Lessee shall Lava the right to remove the property prior to <br />the expiratiom of tb3s Lease so long as no monetary defaults exisk On termination of this <br />Lease for any cause other than nonpayment of royalties hereunder, Lessee shall have the <br />right to remove all such improvements and equipment within one hundred taeaty { 120) days <br />from the date oftermination. If the Lease is temtinated for the non-paynnent of royalties, <br />upon paymemt by Lessee of any delinquent royalties, Lessee shall then have the right to <br />remove all such improvements and equipment within sixty (60) days thereafter. Lessee shall <br />have one hundred twenty (120) days from the date oftezmirration to remove any materials <br />ruined and processed but not removed on the date of termination subject to payment of <br />royalties as provided in this Lease, <br />Jx. IJTFICATIOAt <br />Lessee agrees to indenvrify Lessor against liability, including any resulting costs <br />and/or attameys' fees, on all claims for damages and injuries to persom or property that are <br />claimed to have resat±ed from the activities or omissions of Lessee or its agents or employees <br />during the terms of this Lease. Lessor agrees to indawni:Ey Lessee against liability, including <br />any resulting costs and/or attorneys' £ees, for any breach of the warranties set forth in Section <br />XVI. <br />~. <br />Lessor agrees that during the term of this Lease, including renewal periods, Lessee <br />shall have the exclusive right and option to purchase and remove any and all sand, gravel, <br />rock andlar dirt upon we Leased Property. <br />
